Terms and Conditions
These terms explain cancellation, website ownership and service-area exclusivity for the Strategic Mind plans described on Pricing.
- Exclusive to your service area: your fee buys you the only rights to this platform in your own service area, for your trade, for the life of your contract. That's your own site's service area on Private Website, or your own region on Shared Regional Website. We will not sign a competitor in the same area and trade.
- Your region is defined by postal code (Shared Regional Website only): your region is the Canada Post Forward Sortation Area (the first three characters of a postal code, e.g. M5V) that your business serves.
- Downtown regions carry a markup (Shared Regional Website only): the published rate schedule is the same for every company on your shared site regardless of region, except a downtown FSA, which carries an additional markup on top of the base rate to account for the higher cost of operating there.
- Perpetual contract. 3 months' written notice to cancel.
- Buyout fee if you leave (Private Website only): your website and content transfer to you only for a fee: 3 times your current monthly rate. A Shared Regional Website client has no separate site to buy back. Your region is simply turned off when you leave, with no fee.
- Domain, SSL, and email management (Private Website only): for the life of your contract, we hold and manage your domain's DNS, keep its SSL certificate provisioned and renewed, and manage your business email account (including its SPF, DKIM, and DMARC records) so your automated messages land in the inbox, not spam. The buyout fee above transfers your website and content, not the domain registration itself; domain-transfer terms are agreed as part of the same buyout negotiation. A Shared Regional Website client has no separate domain or business email account under this term.
- You review your own content for accuracy. We draft your website content and images, including AI-generated images where you haven't supplied your own, but you are the source of truth on your own business's facts. Review everything we publish on your behalf before it goes live.
- Shared Regional Website is a sub-contracting arrangement. We generate and route leads and run your operational workflow; the contract for the work itself stays between you and your own customer. We are not responsible for your customer paying you for completed work, and we are not responsible for insuring your own workers, including while they're on a customer's property. Both stay your own responsibility as the business performing the work.
- Our fee applies only to a lead we routed to you. A job that started as a call, form, or booking through your regional site creates a fee once it's paid. A repeat customer, your own referral, or a call to the number on your truck or sign creates no fee, because we did not generate or route that lead.
- You need to offer every service your shared site describes (Shared Regional Website only). The shared site's service list is fixed for your trade vertical (one page reused across every company on it instead of custom copy per company is what keeps this delivery model cheap and fast to launch), so participating means you can actually deliver each one it lists. A homeowner who calls for a listed service you can't do costs the whole site trust, not just your own region. We also reserve the right to adapt how a described service is worded, to match the trade's own common practice and current online-marketing and search expectations, rather than your own internal terminology exactly.
- Advertising is billed at cost plus a 30% platform fee wherever it's billed as its own line item: on the Private Website, or on a Shared Regional Website when a majority of that site's own participating companies want dedicated paid advertising for it. When that majority is reached, every participating company on that site is billed a share of the cost (including a company that didn't ask for it), since the campaign runs against the shared site all of them occupy: it lifts the whole site, not one region on it, so there's no way to charge only the companies who asked. We go by majority instead of requiring everyone to agree, so one company can't block a campaign the rest of the site already wants.
- Payments are processed by EFT. Your customer pays by electronic funds transfer, directly into your own business account: your revenue does not pass through an account of ours. Where our fee applies (Shared Regional Website's 10% down to 6%, tiered by your Google rating, see Pricing), it's split out of that same EFT and routed directly into our own account, at the moment your customer pays. If a job is paid in more than one EFT (a deposit and a later final balance, for example), each payment splits the same way individually, at your current rate, as it clears. EFT transfers are capped at $10,000 per transaction, so a job priced above that settles as more than one transaction.
